Herro had previously told the court that the children had stayed overnight with him after the separation.<\/p>\n<p>In the response described by TMZ in its <a href=\"https:\/\/www.tmz.com\/2026\/09\/11\/tyler-herro-denies-ex-claims-about-his-behavior\/\" target=\"_blank\" rel=\"noopener\">Sept. 11 report<\/a>, Herro proposed either equal parenting time or an arrangement giving him the majority of time with the children.<\/p>\n<h2>She Wants Final Authority Over Health, School and Activities<\/h2>\n<p>Henry says shared parental responsibility would be in the children\u2019s best interests, provided she receives \u201cultimate decision-making authority\u201d over health care, education and extracurricular activities.<\/p>\n<p>Under <a href=\"https:\/\/m.flsenate.gov\/Statutes\/61.13\" target=\"_blank\" rel=\"noopener\">Florida law<\/a>, a court can assign one parent final responsibility for specific areas of a child\u2019s welfare while retaining shared parental responsibility. The parenting plan separately sets out when the children will spend time with each parent.<\/p>\n<p>In an arrangement with ultimate decision-making authority, parents still consult and attempt to agree. That response preceded Henry\u2019s latest challenge to his account of overnight visits.<\/p>\n<h2>Both Parents Filed Petitions Before Herro Withdrew His<\/h2>\n<p>Herro and Henry filed separate petitions on Aug. 20, as <a href=\"https:\/\/sports.yahoo.com\/articles\/tyler-herro-katya-elise-henry-132353450.html\" target=\"_blank\" rel=\"noopener\">Wealth of Geeks<\/a> previously reported. He dismissed his case less than a week later, while hers continued.<\/p>\n<p>Henry described herself as the children\u2019s primary caregiver and said she had handled most of their major decisions. Her petition sought primary custody, a formal parenting plan and court-ordered financial support.<\/p>\n<p>She also asked the court to consider the difference between their incomes when calculating support, pointing to Herro\u2019s earnings as a professional basketball player.<\/p>\n<p>Herro maintained that he was not behind on payments.
