A Plea Deal Requires 15 Years in Jail"},"content":{"rendered":"<p><\/p>\n<div itemprop=\"text\">\n<p>A Yuma doctor accused of using medical businesses he controlled to bill Arizona\u2019s Medicaid program more than $36 million in a matter of months could spend 15 years in prison under a proposed plea agreement filed in his criminal case.<\/p>\n<p>Dr. Irfan Fazil, 54, founder of Bio Family Clinic, is accused of operating a racketeering enterprise that defrauded the Arizona Health Care Cost Containment System, known as AHCCCS, between July 2025 and May 2026.<\/p>\n<p>Investigators say three AHCCCS-enrolled provider businesses controlled by Fazil and his spouse submitted more than $36 million in claims between July and December 2025 alone. The billing included tens of thousands of X-rays, more than 10,000 ultrasounds and more than 1,000 ECGs, according to <a href=\"https:\/\/kyma.com\/news\/top-stories\/2026\/06\/04\/yuma-doctor-arrested-charged-with-multiple-felonies-in-attorney-general-investigation\/\" target=\"_blank\" rel=\"noopener\">KYMA<\/a>.<\/p>\n<p>The case took a major turn Aug. 25 when a plea agreement was filed calling for a 15-year prison sentence. Multiple people said they never received services billed under their names, while some were outside Arizona or even outside the United States on dates when the records indicated treatment occurred.<\/p>\n<p>The volume of diagnostic procedures also drew scrutiny, including the tens of thousands of X-rays, more than 10,000 ultrasounds and more than 1,000 ECGs cited in the probable-cause records.<\/p>\n<h2>The State Accused Him of Operating a Racketeering Enterprise<\/h2>\n<p>The case became part of Arizona\u2019s participation in the 2026 National Health Care Fraud Takedown. The <a href=\"https:\/\/www.azag.gov\/press-release\/attorney-general-mayes-announces-42-indictments-part-national-healthcare-fraud\" target=\"_blank\" rel=\"noopener\">Arizona Attorney General\u2019s Office<\/a> said Fazil was charged with fraudulent schemes and artifices, illegal control of an enterprise, theft, conspiracy and drug-related felonies.<\/p>\n<p>Prosecutors allege the enterprise operated from July 2025 through May 2026 and that Fazil conspired with another person to commit money laundering and theft. Bio Family Clinic was separately charged with fraudulent schemes and artifices.<\/p>\n<h2>The Proposed Deal Calls for 15 Years in Prison<\/h2>\n<p>Under the agreement filed Aug. 25, Fazil would receive a 15-year prison sentence for fraud, illegal control of an enterprise and theft, <a href=\"https:\/\/kyma.com\/news\/crime\/2026\/08\/25\/plea-agreement-filed-for-yuma-doctor-accused-of-fraud\/\" target=\"_blank\" rel=\"noopener\">KYMA reported<\/a>.<\/p>\n<p>The proposed deal calls for conspiracy and possession of dangerous drugs charges to be dismissed. It would also require Fazil to give up his medical license and Drug Enforcement Administration registration. Another provision requires Fazil to provide authorities with passwords to his cellphones and laptops.<\/p>\n<h2>The Plea Has Not Been Entered Yet<\/h2>\n<p>Fazil remains in the Yuma County Detention Center on a $50 million bond. Although the written agreement has been filed, KYMA reported Aug. 25 that he had not yet formally entered the plea before a judge.<\/p>\n<p>His next court appearance is scheduled for Sept. 4. Until the plea is entered and accepted, the proposed 15-year disposition is not a final sentence.<\/p>\n<h2>Patients Can Report Medical Services They Never Received<\/h2>\n<p>Medical billing fraud can sometimes be detected by the people whose identities appear on claims, particularly when records show appointments, tests or procedures that never occurred.<\/p>\n<p>The <a href=\"https:\/\/www.azahcccs.gov\/fraud\/reportfraud\/\" target=\"_blank\" rel=\"noopener\">AHCCCS Office of Inspector General<\/a> specifically identifies billing for services or supplies that were never provided, double billing, overbilling and incorrect coding as examples of potential provider fraud.<\/p>\n<p>AHCCCS members who notice an unfamiliar service should compare the information with their own medical records and contact their health plan or provider for clarification. Dates when the patient was elsewhere, procedures the patient does not recognize or repeated services that never occurred should not simply be ignored.<\/p>\n<p>Suspected provider fraud can be reported directly to AHCCCS OIG.
