{"id":348620,"date":"2026-03-31T23:19:30","date_gmt":"2026-04-01T04:19:30","guid":{"rendered":"https:\/\/www.etrafficlane.com\/60dollarmiracle\/heres-a-look-at-birthright-citizenship-and-how-the-world-sees-it-as-supreme-court-case-looms"},"modified":"2026-03-31T23:19:34","modified_gmt":"2026-04-01T04:19:34","slug":"heres-a-look-at-birthright-citizenship-and-how-the-world-sees-it-as-supreme-court-case-looms","status":"publish","type":"post","link":"https:\/\/www.etrafficlane.com\/60dollarmiracle\/heres-a-look-at-birthright-citizenship-and-how-the-world-sees-it-as-supreme-court-case-looms","title":{"rendered":"Here is a have a look at birthright citizenship, and the way the world sees it, as Supreme Courtroom case looms"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div data-testid=\"prism-article-body\">\n<p class=\"EkqkG IGXmU nlgHS yuUao MvWXB TjIXL aGjvy ebVHC \">The Supreme Court is <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/supreme-court-birthright-citizenship-trump-immigration-constitution-e51d13b21b4240f6b8625700abe6030e\">once again<\/a> hearing arguments on whether <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/hub\/donald-trump\">President Donald Trump<\/a> can <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/supreme-court-immigration-trump-birthright-citizenship-83f70d58636219c0ff98c7d765ab2b4d\">deny citizenship<\/a> to children born to parents who are in the United States illegally or temporarily.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The Wednesday case stems from an executive order Trump signed on the first day of his second term ending what\u2019s known as birthright citizenship, which guarantees citizenship to nearly everyone born on U.S. soil.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">While the concept has been part of U.S. law for well over a century, it is relatively rare around the world. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Birthright citizenship is based on the legal principle of jus soli, or \u201cright of soil.\u201d<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">In the U.S., the right was enshrined in the Constitution after the Civil War, in part to ensure that former slaves would be citizens.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">\u201cAll persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States,\u201d the 14th Amendment states.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">In the late 1800s, <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/trump-birthright-citizenship-native-chinese-executive-order-c163bbadd20609bd09fd5c5bccc6ba8d\">birthright citizenship was legally expanded<\/a> to the children of immigrants.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Wong Kim Ark, who was born in the U.S. to Chinese parents, sued after traveling overseas and being denied reentry into the U.S. The Supreme Court eventually ruled that the amendment gives citizenship to everyone born in the U.S., no matter their parents\u2019 legal status.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Today there are only a handful of birthright exceptions, such as for children born in the U.S. to foreign diplomats.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Only about three dozen countries, nearly all of them in the Americas, guarantee citizenship to children born on their territory.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Most countries follow the principle of jus sanguinis, or \u201cright of blood,\u201d with a child\u2019s citizenship based on the citizenship of their parents, no matter where they are born.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">None of the 27 member states of the European Union, for example, grant automatic, unconditional citizenship to children born on their territories to foreign citizens. The situation is similar across much of Asia, the Middle East and Africa. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Some countries use a combination of principles, such as parenthood, residency and ethnicity, to decide a child&#8217;s citizenship.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Australia, for example, allowed birthright citizenship until 1986. But starting that August, children born there could only become citizens if at least one parent was an Australian citizen or a permanent resident. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Things shifted the other way in Germany, which changed its citizenship laws in 2024.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Until then, citizenship by birth required that at least one parent was German.
