{"id":343684,"date":"2026-03-10T08:37:03","date_gmt":"2026-03-10T13:37:03","guid":{"rendered":"https:\/\/www.etrafficlane.com\/60dollarmiracle\/judge-disqualifies-trio-of-lawyers-tapped-to-lead-new-jerseys-federal-prosecutors-office"},"modified":"2026-03-10T08:37:07","modified_gmt":"2026-03-10T13:37:07","slug":"judge-disqualifies-trio-of-lawyers-tapped-to-lead-new-jerseys-federal-prosecutors-office","status":"publish","type":"post","link":"https:\/\/www.etrafficlane.com\/60dollarmiracle\/judge-disqualifies-trio-of-lawyers-tapped-to-lead-new-jerseys-federal-prosecutors-office","title":{"rendered":"Decide disqualifies trio of attorneys tapped to guide New Jersey&#8217;s federal prosecutor&#8217;s workplace"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div data-testid=\"prism-article-body\">\n<p class=\"EkqkG IGXmU nlgHS yuUao MvWXB TjIXL aGjvy ebVHC \"><span class=\"oyrPY qlwaB AGxeB \">TRENTON, N.J. &#8212; <\/span>A judge on Monday disqualified three Justice Department officials from overseeing federal prosecutions in New Jersey, saying they were appointed as part of an illegal power grab by the Trump administration.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The scathing, 130-page ruling is the latest development in a long-running fight between the judiciary and President Donald Trump over the process for selecting U.S. attorneys, who ordinarily must undergo Senate confirmation to stay in their positions. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">U.S. District Judge Matthew Brann ruled last year that Trump&#8217;s first choice for U.S. attorney, his former personal attorney Alina Habba, <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/alina-habba-new-jersey-prosecutor-trump-5cb7573a91ac776e3914afd584e814bf\">was barred<\/a> from the role because she had stayed too long without Senate confirmation.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">On Monday, Brann swatted down Attorney General Pam Bondi&#8217;s unusual decision to replace Habba indefinitely with three Justice Department officials who would share authority for the office.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The judge said naming the three people \u2014 Philip Lamparello, Jordan Fox and Ari Fontecchio \u2014 to the role formerly held on an interim basis by Habba constituted yet another violation of the Appointments Clause of the Constitution, which requires Senate confirmation.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Brann also ruled that the Trump administration&#8217;s maneuvers amounted to an \u201cenormous assertion of Presidential power.\u201d<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">\u201cIt is plain that President Trump and his top aides have chafed at the limits on their power set forth by law and the Constitution. To avoid these roadblocks, this administration frequently purports to have discovered enormous grants of executive power hidden in the vagaries and silences of the code,\u201d Brann wrote.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Habba, who has remained with the Justice Department as a senior adviser, called the ruling \u201cridiculous.\u201d<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">\u201cJudges may continue to try and stop President Trump from carrying out what the American people voted for, but we will not be deterred,\u201d she wrote on social media. \u201cThe unconstitutionality of this complete overreach into the Executive Branch, time and time again, will not succeed.\u201d<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">U.S. law normally requires Senate confirmation for U.S. attorneys, and only allows people to serve in the position without that confirmation for limited periods.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Under Trump, however, the Justice Department has sought to leave unconfirmed prosecutors in their positions for far longer, often through novel personnel maneuvers that courts have later ruled to be improper.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Brann, in his decision, argues there are \u201cat least three undisputedly legal methods\u201d for the Trump administration to fill the New Jersey post and resolve the controversy.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">&#8220;With all these options remaining, why does the fate of thousands of criminal prosecutions in this District potentially rest on the legitimacy of an unprecedented and byzantine leadership structure?&#8221; he wrote. \u201cThe Government tells us: the President doesn\u2019t like that he cannot simply appoint whomever he wants.\u201d<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">In an at times irritated and scolding tone, the judge says the Trump administration \u201ccares far more about who is running\u201d the federal prosecutor&#8217;s office in New Jersey than \u201cwhether it is running at all.\u201d<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">\u201cI am not fooled by the Government\u2019s superficial arguments,\u201d he wrote at another point.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Judges have ruled, in separate cases, that people installed as the top federal prosecutors for Nevada, Los Angeles and northern New York were all serving unlawfully.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Lindsey Halligan, <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/letitia-james-eastern-district-of-virginia-trump-8c84bd8603a4b932f9cb2e451ef057a3\">who pursued indictments<\/a> against a <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/halligan-comey-james-trump-ffcb0688ddf013161ec0b9b4c13681f4\">pair of Trump\u2019s adversaries<\/a>, left her position as acting U.S. attorney in Virginia after a <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/comey-james-justice-department-5ec1a59d152bc1fd000ade15e20745b5\">judge concluded<\/a> in November that her appointment was unlawful. The judge also ruled that <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/comey-james-justice-department-5ec1a59d152bc1fd000ade15e20745b5\">indictments she brought<\/a> against New York Attorney General Letitia James and former FBI Director James Comey must be dismissed.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC eTIW sUzSN \">In some instances, judges have exercised their power under the law to appoint U.S. attorneys to oversee prosecutor offices until one of the president&#8217;s picks is confirmed by the Senate.
